Thiruvananthapuram: The appointment of retired Justice Babu Mathew P Joseph as the chairman of the professional course fee regulatory authority sparked a controversy. Save Education Campaign Committee (SUCC) chairman and the petitioner in the CMDRF misuse case alleged that the appointment of the retired Lok Ayukta judge was against the rules.In a petition to chief minister Pinarayi Vijayan, Sasikumar demanded the cancellation of Joseph’s selection and alleged that his appointment was a gift by the chief minister for saving him in the CMDRF misuse case. “The appointment of Joseph is in contravention of the Lok Ayukta Act, which prohibits Lok Ayukta judges from holding positions with govt benefits after retirement. The appointment of Joseph as the authority chairman is illegal and will be challenged as a quo warranto petition,” Sasikumar said.A full bench of Lok Ayukta, with Joseph, originally ruled that Lok Ayukta could consider the petition against the alleged misuse of CMDRF by state cabinet led by Vijayan. However, later, a new full bench, in which Joseph was also a member, agreed to review the case to assist the chief minister. After detailed arguments, the three-member full bench dismissed the petition after re-examining its validity due to differing opinions from Justice Cyriac Joseph and Upa Lokayukta Justice Haroon-Ul-Rasheed.
